§ 1 Scope of Application (1) These General Terms and Conditions apply to all contracts for the provision of services between Green Thai Spa (hereinafter “Provider”) and its customers. (2) The Provider exclusively provides services in the field of traditional Thai massages and wellness treatments. (3) Deviating terms and conditions of the customer shall not become part of the contract unless the Provider has expressly agreed to them in writing.

§ 2 Services of the Provider (1) The Provider exclusively offers traditional Thai massages and related relaxation treatments. All services serve the purpose of relaxation, well-being, and the promotion of physical and mental regeneration. (2) The services do not replace medical treatment, therapy, or medical diagnosis. The Provider does not practise the healing arts. (3) No sale of products or goods takes place. (4) Massage appointments are only allocated by prior arrangement.

§ 3 Appointment Booking and Conclusion of Contract (1) Appointments can be arranged by telephone, e-mail, via the website, or on site. (2) The contract is concluded upon confirmation of the appointment by the Provider. The booking is binding. (3) The customer receives an appointment confirmation stating the time and duration of the treatment.

§ 4 Health Prerequisites (1) Before each treatment, the customer warrants that there are no health restrictions or contraindications that would exclude or only permit limited Thai massage (e.g. acute inflammations, thromboses, severe cardiovascular diseases, pregnancy in the first trimester, open wounds, recent operations, cancer in the acute phase, or epilepsy). (2) In case of uncertainties or pre-existing conditions, the customer is obliged to consult a doctor before the treatment. (3) The Provider reserves the right to refuse a treatment in the event of recognisable health concerns. (4) All health-relevant information must be truthfully and completely disclosed before the treatment.

§ 5 Prices and Payment Terms (1) The prices valid at the time of booking according to the current price list on the website or in the studio shall apply. All prices are final prices including statutory value-added tax. (2) Payment is due immediately after completion of the treatment and may be made in cash or by EC/debit/credit card. (3) An invoice will be issued upon request.

§ 6 Cancellation, Rescheduling and Cancellation Fees (1) Free cancellation or rescheduling is possible up to 24 hours before the agreed appointment. (2) In the event of cancellation or rescheduling within the last 24 hours before the appointment, a cancellation fee of 20 % of the agreed treatment price shall be due. (3) In the event of failure to appear at the agreed appointment (no-show) without prior cancellation, a cancellation fee of 20 % of the original treatment price shall likewise be charged. (4) In the event of the customer’s lateness, the treatment time shall be shortened accordingly. The full treatment price remains due. (5) The Provider reserves the right to postpone or cancel appointments at short notice in cases of force majeure (e.g. illness of the masseur, power failure). In this case, no costs shall arise for the customer.

§ 7 Vouchers (1) Vouchers may be purchased and are transferable. (2) Vouchers are not redeemable for cash and are valid for 3 years from the date of issue. (3) In the event of loss of the voucher, there is no entitlement to replacement or reimbursement. (4) Remaining balances will not be paid out. Redemption is only possible after prior appointment arrangement.

§ 8 Liability (1) The Provider is liable without limitation for intent and gross negligence as well as for damages arising from injury to life, body, or health. (2) In the event of slight negligence, the Provider is only liable for the breach of essential contractual obligations (cardinal obligations). (3) The Provider is not liable for damages arising from the concealment of health restrictions or improper use of the treatment. (4) No liability is assumed for valuables, clothing, or other personal belongings brought by the customer.

§ 9 Data Protection (1) The Provider processes the customer’s personal data (name, contact details, health information) exclusively for the performance of the contract and in strict compliance with the General Data Protection Regulation (GDPR). (2) Disclosure to third parties takes place only to the extent necessary for the performance of the contract or if express consent has been given. (3) The customer has the right at any time to information, rectification, erasure, and objection regarding his or her stored data.

§ 10 Final Provisions (1) Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected. The invalid clause shall be replaced by a valid one that comes closest to the economic purpose. (2) The law of the Federal Republic of Germany shall apply exclusively. (3) The place of jurisdiction is Düren, provided the customer is a merchant, a legal entity under public law, or a special fund under public law. (4) Amendments to these GTC will be notified to the customer in good time and shall be deemed accepted if no objection is raised within 14 days of notification.
